An investor who wants to set up a company in NL
The investor (Highly Skilled Migrant) who wants to invest in a (new) company in the Netherlands. At first he will participate in this company as a natural person (privately) or indirectly through a Personal Holding in the company to be established.
The investor does not need a working or residence permit to set up a company in The Netherlands. However to stay in The Netherlands and to be employed by his own company a residence permit is obliged. To work in the Netherlands as a highly skilled migrant, is only possible if the company he works for is a recognized sponsor at the IND (Immigration and Naturalization Office). The investor can be employed as a Highly Skilled Migrant and apply for a visa. The only possibility for the person employed (directly or indirectly) by his own company is that the employee has no more than 24,9% of the shares in the start-up company.
